Selling

Selling an Inherited or Estate Home

Selling a parent's or relative's home usually comes at a hard time, and it adds tasks most people have never handled: court paperwork, a house full of belongings, repairs nobody has looked at in years, and family members who may not agree on what to do.

Dan Wiechart has handled probate and estate sales in Virginia, West Virginia and Maryland, including homes that needed a few repairs and homes that needed a complete cleanout. His job is to take as much of the property side off your plate as possible while you work with your attorney on the legal side.

How an estate sale usually works

  1. Confirm who can sell. In most cases the executor or personal representative named by the court signs the listing and the contract. Your estate attorney can confirm what authority you have and whether court approval is needed for the sale.
  2. Secure and assess the house. Change the locks if needed, keep utilities and insurance active, and walk through to see what condition it is in.
  3. Decide on cleanout and repairs. Some estates sell as-is; others do light repairs and a cleanout to reach more buyers. Dan can show you what each choice is likely to mean for price and timing.
  4. Price, list and sell. The home is priced from recent comparable sales, marketed, and taken through to closing, with updates to the executor and family along the way.

Common questions

Can I sell a house before probate is finished? It depends on the state, the will and the court. Ask your estate attorney early so the listing timeline lines up with the legal process.

Do I have to clean out the house first? No. Many estate homes sell with belongings still inside. Dan can connect you with cleanout and estate-sale companies if you want to clear it.

What if family members disagree? It helps to agree on a price range and a timeline in writing before listing. Dan can provide a pricing review everyone can look at.
